Terms for Wacom Manga & Anime Days

These specific terms (“Event Terms”) are terms that apply between you as participants and Wacom Europe GmbH (“Wacom”) with respect to the event called Wacom Manga & Anime Days (“Event”). This Event is one of the online services offered by Wacom (“Wacom Services”). Accordingly, except otherwise provided herein, all the Terms of Use for Wacom Services (“Terms”) https://www.wacom.com/terms-of-use will apply or apply mutatis mutandis to this Event such that participants in this Event being “user(s)” or “User(s)” of Wacom Services under the Terms, and these Event Terms will additionally apply as part of these Terms.  Wacom may, at its own discretion, change or cancel the contents of this Event at any time, with or without notice to you. These Event Terms, together with the Terms for the Wacom Services govern the relationship between Wacom and the participants from the time of registration until the time of confirmed cancellation or termination. Participation in the Event presupposes that the participant agrees to the Terms and Event Terms and has taken note of the rules for handling personal data in accordance with the applicable data protection laws and regulations and Wacom privacy policy at https://www.wacom.com/privacy (“Privacy Policy”), cookie notice at https://www.wacom.com/cookie-notice and Wacom’s privacy notice for this Event available at https://content.wacom.com/acton/media/43271/wacom-manga-anime-days-privacy-notice (“Event Privacy Notice”)

  1. Functions and purpose of the Event

The Event is a three-day Wacom event that aims to promote, feature, and celebrate the Japanese art style of Anime and Manga and Wacom’s long-time relationship with artists who follow and create Manga and Anime art. The lineup of speakers will cover topics and give the registered audience opportunities (i) to learn valuable insights on pursuing a creative career in Anime and Manga industry in and outside of Japan, (ii) to learn the tips and tricks from professionals through their sessions and their answers to key questions, and (iii) to have their portfolio reviewed by professionals. The Event will bring in professionals and companies to share knowledge and to collect leads in the creative field.

  1. Conditions of participation

Only private individuals who are 18 years of age or equivalent minimum age in the relevant jurisdiction can participate in the Event. Having Wacom ID is not required. Any provisions relating to creation of Wacom ID in the Terms will therefore not apply to the Event.   

  1. Registration and user account

To access the Event, the participant must register by filling in a registration form prescribed by Wacom on Wacom’s web page and create a user account (Participant having created a user account being called “User”). Each User may only register once.

Users can also submit their personal portfolios to Wacom and to have them reviewed by  professionals. After successful registration to the event, users will receive a confirmation e-mail with the details included for portfolio submission. Those who wish to submit their portfolios will be asked to send their portfolios to a designated e-mail address with a unique identifier number that will be part of the confirmation e-mail. Only PDF files with a minimum of 3 maximum of 10 artworks, or online portfolio link (Pixiv, Artstation, Deviantart, Behance, YouTube, Vimeo, personal website, etc.) will be accepted as portfolio. Direct download links to portfolios (WeTransfer, Dropbox, etc.) will not be accepted. After the evaluation process, selected portfolio owners will be reached out via their registered e-mail address and invited to participate in the live portfolio review session. Participation to live portfolio review session is subjected to consent of the portfolio owners. Submitting your portfolios does not guarantee or enforce live portfolio review participation. All submitted portfolios except for those selected for review will be deleted 30 days after the end of the event.

Wacom is entitled to refuse registration without giving any reason. The User is not entitled to register or participate in the Event with incorrect, incomplete or outdated information of the User and must provide the correct and complete data required for registration and keep it up to date. The Privacy Policy and Privacy Notice apply to personal data provided by the User The user will not include in his/her user profile any photos, trademarks, trade names, logos or other details that are inappropriate or offensive or that infringe the personal rights or intellectual property rights of Wacom or third parties.

In the event of a breach of the provisions of Sections 2 and 3, Wacom or its affiliates may block the user account or user name at any time without liability to the User or anyone else. If it is not possible to cure the breach of the rules or if the User does not remedy the breach within a reasonable period of time, Wacom or its affiliates may terminate participation in the Event and delete the User's data without liability to the User or anyone else.

Wacom or its affiliates are entitled, but not contractually obliged towards the users, to check the personal data provided by the Users and/or the content posted or transmitted by them for correctness, completeness, legality and freedom from viruses.

The User shall ensure that the User name and password are not accessible to third parties and is liable for all activities carried out under the User name. The User shall inform Wacom or its affiliates immediately if he/she has reason to suspect that his/her password has been disclosed to or otherwise obtained by any third party.

  1. Deregistration Opt-out / Termination

The User can deregister from the Event at any time. If the User would like to withdraw from the Event and to deregister, please follow the instructions as set forth below:

Users can end the event email communications by clicking the opt-out link at the footer of every e-mail communication they will receive from Wacom. If a user wishes to deregister, they can submit their request via Wacom support team https://www.wacom.com/en-de/support/contact-support or live chat on wacom.com. Users who have opted-in for marketing e-mail communications during their registration will receive Wacom Creative Newsletters including creative news, product updates, promotions, and news from Wacom. Users can opt-out of marketing e-mail communication by clicking on the opt-out link at the footer of any e-mail, any time they wish.

Wacom or its affiliates reserve the right in their sole discretion to: (i) deregister the User; (ii) delete any of the User account; (iii) restrict the User’s use of all or any part of the Wacom Sites or the Wacom Services; and (iv) suspend, modify or discontinue the Wacom Sites or Wacom Services (or any part thereof), for any or no reason, without notice, and without liability or payment obligation to the User or anyone else. Wacom or its affiliates also reserve the right to block the Users from accessing or posting content to the Wacom sites or the Wacom Services by using any technology available, such as blacklisting certain IP addresses or device numbers.

After confirmation of the deregistration by Wacom or its affiliates, the User no longer has access to the Event and the User data provided at the registration will be forthwith deleted.  Wacom or its affiliates are entitled but not obliged to delete the content and contributions made by the User. The usage and exploitation rights for Wacom described below continue to exist. All rights granted to the User automatically cease to apply upon deregistration. In addition, the User may request to delete their personal data in accordance with Wacom’s Privacy Policy.  Further information on the rights as an affected party can be found in Wacom’s Privacy Policy.   

  1. Costs

Registration and participation in the Event is free of charge for the User. The User must provide for his/her connection to the Internet, the establishment of communication links, the necessary hardware and software and the procurement of the posted content at his/her own expense.

  1. Event Details

6.1 The Event is scheduled to be held on July 28, 29 and 30, 2021.   

Every User that register for the Event receives following communication:

  1. Registration confirmation e-mail with link to the sessions provided
  2. Last 24/48 hour event reminder e-mail
  3. Communication for any schedule or speaker changes 
  4. Follow up email with links to session recordings
  5. e-Store offers from Wacom (for those who have consented to receive marketing emails).

 6.2 The activities conducted in the Event include the following:

  1. PORTFOLIO REVIEW:

Users can submit their portfolio and have it reviewed and commented by professionals and chief designers. Users may choose to submit their portfolio and have them reviewed by professionals in creative area to be selected for live evaluation sessions. The selected portfolio(s) will get an award from Wacom. 

Users whose portfolios are selected for live evaluation sessions or will be introduced in live sessions are required to fill in a consent form prescribed by Wacom regarding the posting of their portfolios and their personal information (such as names) online. The selected portfolio owners will be presented with their names, if the user wishes to share more information about themselves like their country, education or work information, it is up to their choice to do so. If a user wishes some or all of the personal information to be taken out of the video after the event, they can submit their request to portfolios@wacom.com and that information will be taken out of the recording..

  1. LEARN FROM THE MASTER

Users can learn from professionals and ask what tools they are using in creating Manga and Anime art. Professionals may share their tips and tricks on the Event.

  1. HOW TO BE SUCCESSFUL

Users can get insights, tips, and tricks as well as answers to their questions on how to pursue a successful career as an artist creating Manga & Anime art. The sessions will include different aspects of a professional career such as freelance careers and careers as a studio artist. Speakers will answer key questions from the audience.

The Event will be arranged on Zoom using Zoom meeting function and streamed on YouTube live. Users can post their questions and comments on chat or comment functions of YouTube during or after the live sessions. Wacom will not use or store any personal information indicated in the chat or comment functions. Users should be aware that it is Users’ responsibility to choose to include their personal information in their account names which will be shown on YouTube chat or comment functions.

6.3 Wacom or its affiliates are entitled to record the contents of the Event, and store them for an indefinite period until the related Participant,  speaker or selected portfolio owner on contents request to delete. Except for portfolio review session, Wacom will share such recorded contents in various media such as on Wacom YouTube channel and other Wacom social media platforms including Twitter, Instagram and Facebook and use them for improvement of Wacom products and Wacom Services for creation of advertorial and promotional materials of Wacom and its affiliates,

6.4 Wacom reserves the right, in its sole discretion, to change, reject, limit or block access to all or any part of the Event at any time, with or without notice to the User. In particular, Wacom makes no promise on any Event being made as scheduled (due to server availability, maintenance, updating work or other circumstances). The User should fully understand that Wacom may exercise the above right if the User violates the User’s obligations under the Terms and the Event Terms.

  1. Confidentiality

The User will treat the contents of e-mails and messages from the Event or contents of topics or contributions published or posted in the Event of the Event as confidential and will not pass them on to third parties or use them for purposes outside the Event.

  1. User’s Obligations to Participate in Event

8.1 In connection with the User’s participation in the Event, the User agrees to the following in addition to the User’s obligations provided elsewhere under the Terms. If the User does not agree, the User will not be allowed to participate in the Event.

  1. Ensure information provided to Wacom for participation in the Event ("Registration Information") to be accurate, current and complete, and keep the Registration Information up to date;
  2. Ensure the Registration Information is personal to you and do not assign, rent, sell, resell, sublicense, distribute, or otherwise transfer the eligibility for participation (including that for the Event at the venue) to a third party;
  3. Do not use other participant's Registration Information and do not allow a third party to use your Registration Information (including the password);
  4. Keep the Registration Information (including the password) secure and confidential;
  5. Immediately notify Wacom if the User has reasonable grounds to suspect that the Registration Information (including the password) has been disclosed to or obtained by a third party;
  6. Prepare and maintain the device and network environment necessary to participate in the Event at the User’s own expense and responsibility;
  7. Take self-responsibility for any trouble with other participants and acknowledge that Wacom or its affiliates should not take any responsibility;
  8. Respect other participants and be polite to them even if the Use disagrees. Wacom or its affiliates do not tolerate behavior that can be interpreted as harassment, threats, racism, insults or hatred;
  9. Follow any direction given by Wacom or its affiliates with respect to topics to be discussed in the Event;
  10. Although the Events in this Event are not publicly accessible, decide whether the User wishes to include information in his/her contributions to the Event that could reveal his/her personal identity, such as his/her address, telephone number or e-mail address. In general, the User should not include information that he/she does not want to make publicly available;
  11. Use Wacom Contents posted to the Event only for the purpose intended for the Event;
  12. Do not record or disclose the contents of the Event in any form including, but not limited to, audio recording, visual recording, screen shot;
  13. Follow the precautions that Wacom or its affiliates notify by any means including, but not limited to, an e-mail regarding the Event; and
  14. Do not take any acts or make any remarks that Wacom or its affiliates consider inappropriate in light of the purpose of the Event.
  15. User Contents

Any ideas, comments, information, pictures, movies, texts, portfolios and artworks etc. posted by the User to the Event is considered the User Content as defined under the Terms. The User retains ownership of any User Content posted or transmitted on the Events for the Event. The User hereby grants to Wacom or its affiliates, a non-exclusive, royalty-free, worldwide, and sublicensable license and authority to use, copy modify, post, transmit, download, store, distribute, incorporate and otherwise exploit the User Content for this Event, for improvement of Wacom products and Wacom Services or for creation of advertorial and promotional materials of Wacom and its affiliates, in addition to the purposes provided elsewhere under these Terms. This includes in particular the right to edit the User Content (e.g. to shorten, compress, transfer it to other formats, combine it with other content), to reproduce it or transfer it to third parties without having to name the User as the author. These rights of use of the User content by Wacom and its affiliates shall remain in force even after deregistration or termination.

The User also hereby irrevocably and forever waives and agrees not to assert any moral rights which the User may have in any User Content (including, without limitation, any right of paternity or integrity, any right to claim authorship of such User Content, any right to object to any distortion, mutilation or modification of such User Content or any similar right, whether existing under any applicable law.

Wacom and its affiliates accept no responsibility for accuracy, truthfulness, effectiveness, completeness, topicality or suitability of any User Contents posted by the Users of the Event. In no event are Wacom and its affiliates liable for any and all claims, liabilities, damages, losses or costs incurred by the Users arising out of or relating to usage of the User Contents provided or posted by other Users in the Event.

  1. Wacom Contents

Any ideas, comments, information (including pre-release product and/or software information), pictures, movies, texts, etc. posted by Wacom or its affiliates to the Event is considered Wacom Content as defined under the Terms. Under the Event Terms Wacom or its affiliates grant the User the non-transferable, non-sublicensable right to use Wacom Contents provided by Wacom to the User for the Event only for a limited purpose of intended use for such Event. All Wacom Contents that the User receives via the Event may not be rented out or otherwise made available to third parties by the User. The User is not allowed to reproduce, edit, distribute or exploit otherwise without Wacom’s written consent.
