Privacy Notice for Wacom Manga & Anime Days 2021

  1. Your Personal Information

1.1      When you sign up for this Event, you must register your name, contact information (email address) and other necessary items through the website of Wacom Europe GmbH (“Wacom”).

1.2      You agree that Wacom may use your personal information obtained through registration for this Event for the purposes set forth in the privacy policy which you will agree to separately and the following purposes. If Wacom uses your personal information for any other purposes, you will be notified of those purposes.

  1. To send you the link for the session you signed up for and to send you a reminder for the session 24 or 48 hours before the start of the session;
  2. Services incidental to (a) above (for example, announcements by e-mail of changes, cancellations and further guidance of session, as well as confirmatory notifications that are deemed necessary in the course of business);
  3. Send you an email with the link to the recorded sessions after the Event ended, and send e-Store offers to participants who have consented to receive marketing emails. ;
  4. User support for this Event (for example, responding to inquiries);
  5. Making statistical materials compiled in a manner that does not identify or specify individuals, and conducting market analysis by using them, for the reference for sales activities and development of new services;
  6. Use and record of access information (for example, Internet, mobile sites, phones, etc.) for system operation and management and for responding to inquiries; and
  7. Other matters accompanying (a) to (f) above.

1.3      Wacom shall not disclose to a third party any information obtained by Wacom in the course of your registration for and participation in this Event without a justifiable reason, except in the following cases:

  1. in case sharing your provided information to speakers of the session in which you participate;
  2. in case you consent to the disclosure of your personal information (your name, address, gender, age, e-mail address, etc.);
  3. in case Wacom discloses the statistical information collected for the purpose of grasping the participation trend of this Event in a manner that does not identify individuals;
  4. in case of infringement or threat of infringement of copyrights, property rights, privacy, honour, trust or other rights of other participants, third parties or Wacom;
  5. in addition to the preceding item, in case any disadvantage or damage is caused or threatened to be caused to other participants, third parties, or Wacom;
  6. in case disclosure is permitted by laws and regulations;
  7. in case disclosure is required by laws;
  8. in case of request from public authorities; and
  9. in other cases where it is necessary for the operation of this Event.

 

  1. Processing of personal data in the context of provided Portfolios


2.1.   Wacom offers the possibility for artists to provide their portfolio if they are interested in an evaluation during a Live session. Providing a portfolio is voluntary. If you choose to provide your portfolio, employees of Wacom, responsible for this Event, will do a first evaluation in order to make a selection for the Live session. As a next step, a pre-selection of portfolios shall be shared with the external Partner that will join the Live session as a speaker. The external Partner will at that point not receive your name or any other personal data of you but will only see the portfolio itself.

2.2.   It is your obligation to ensure that there is no personal data of third parties included in your portfolio, such as photographs or drawings, names or any other personal data of third parties. Otherwise, it is your responsibility (and you shall also be liable for it) to ensure that you received a proper consent of the person who´s data is disclosed in the portfolio in advance. This consent must fulfil the requirements of all applicable Data Protection laws and regulations. Wacom will, under no circumstances accept such a responsibility or liability. If requested by Wacom, you will provide the consent of the third person to Wacom.

2.3.   If your portfolio is selected for an evaluation during the Live session, you will be contacted by an employee of Wacom via e-mail in advance. In case you prefer by then not to join the session anymore, Wacom will reach out to another artist. In case you would like to join the Live session, Wacom will align with you which personal data you would like to share in the session (e.g. name, age, Job title or if you would like to turn on your camera). To confirm your preferences and document your consent to be part of the recorded session, you will sign a consent form. You may choose not to sign it, but in this case, you cannot join the session.

2.4    The Live session in which the portfolios will be evaluated will be recorded and might be shown (wholly or partly) in any known media, for example but not limited to Wacom´s Website, Wacom´s YouTube channel, in Wacom´s social media channels, for example but not limited to Twitter, LinkedIn or Instagram, in Wacom´s newsletter, on events or in blogs.

3.5    The owners of the portfolios selected and introduced in the session will receive a Wacom product as a reward. If your portfolio is selected for a reward, you will be contacted via e-mail by an employee of Wacom. In this case, you need to provide Wacom an address to where the product may be sent to. You may choose not to provide an address, but in this case, Wacom will not be able to provide you the product. Your address will be deleted after you received the product.

2.6    The portfolio selected and introduced in the session will be part of a post-event blog article. Wacom will align with the owner of the selected portfolio which personal data may be revealed in the article (e.g. your name, Job title, experience). Your preferences and your consent will be documented in the consent form that needs to be signed in order to join the Live session.

2.7    All portfolios with the name of the artists will be stored in a password protected file, accessible on a strict need to know basis and will be deleted 30 days after the Event ended.

 

  1. Joining the session

 

3.1    The session will be held on Zoom and will be streamed via YouTube Live. In case your portfolio is selected for the evaluation and you join the Live session, you will be invited to the Zoom meeting. In this case the Terms and Conditions, the Privacy Policy and any other Policies of Zoom will be applicable as well. Attendees of the Event that watch the session will use solely YouTube Live. Please be aware that the Terms and Conditions, the Privacy Policy and any other Policies of YouTube Live shall be applicable as well.

3.2    The name with which you sign in at YouTube Live will be seen by the employees of Wacom who host the Event and will be shown in the YouTube chat and comments in case you decide to use these functions.

3.3    Wacom or its affiliates are entitled to record the sessions (contents) of the Event and store them on YouTube for an indefinite period or until the related Participant , speaker or selected portfolio owner on the recorded session requests the deletion. Except portfolio review session, Wacom will share such recorded contents in various media such as on Wacom YouTube channel and other Wacom social media platforms including Twitter, Instagram and Facebook and use them for improvement of Wacom products and Wacom Services for creation of advertorial and promotional materials of Wacom and its affiliates.

3.4    Wacom will not use any personal data (if any) appearing on YouTube´s chat and comment functions in relation to the recorded session uploaded by Wacom on YouTube.

3.5    Any personal data you might post in YouTube´s chat and comment functions can be globally seen or accessed. Please acknowledge this and be aware that you post any personal data at your own responsibility.

3.6    Your personal data provided during the registration process will be deleted shortly after the post-event emails are sent to you by Wacom.

  1. International Transfers of Data for Processing

4.1    Personal data that is collected during the registration process is stored and processed within the European Union. The same applies for provided portfolios or addresses provided in order to receive a Wacom product as a reward.

4.2.   If you are chosen to participate in the Live session, your personal data will be transferred outside the European Union. We will provide you the necessary information before you consent to join the Live session.
