Introduction - Event Specific Privacy Notice - Wacom Career Days 2023

(All the capitalized terms are as defined in the Event Privacy Notice below)

  1. Event Outline:

Career Days 2023 (“Event”) will be held by Wacom Europe GmbH ("Wacom”) on May 2, 2023 through May 6, 2023:

 (1) online; and
 (2) at at Wacom Experience Center in
Düsseldorf, Germany ("Event Venue”)

Registration is required for the onsite Venue.  No registration is required for the online viewers or the Venue Attendees in Seoul.  Accordingly, Wacom collects Registration Information only from the Venue Attendees. 

Online sessions are held on Zoom, and streamed, recorded and posted and distributed on.  

Your registration information will not be disclosed by Wacom to the sponsors, event partners or speakers of the Event.

  1. Processing of Personal Data in the Context of Provided Portfolio

2.1 Wacom offers the possibility for artists to provide their portfolio if they are interested in an evaluation during a Live session. Providing a portfolio is voluntary. If you choose to provide your portfolio, employees of Wacom, responsible for this Event, will do a first evaluation in order to make a selection for the Live session. As a next step, a pre-selection of portfolios shall be shared with the external partner that will join the Live session as a speaker. The external partner will at that point not receive your name or any other personal data of you but will only see the portfolio itself.

2.2 If your portfolio is selected for an evaluation during the Live session, you will be contacted by an employee of Wacom via e-mail in advance. In case you prefer by then not to join the session anymore, Wacom will reach out to another artist. In case you would like to join the Live session, Wacom will align with you which personal data you would like to share in the session (e.g. name, age, Job title or if you would like to turn on your camera). To confirm your preferences and document your consent to be part of the recorded session, you will sign a consent form. You may choose not to sign it, but in this case, you cannot join the session.

2.3    The Live session in which the portfolios are evaluated will be recorded and accordingly the name and voice of the portfolio owner as well as the face might be shown in the recorded session. The recording will be shared with the portfolio owners but it will not be available online publicly for repeated viewing.

2.4    The most promising portfolios will receive a Wacom product as a reward. If your portfolio is selected for a reward, you will be contacted via e-mail by an employee of Wacom. In this case, you need to provide Wacom an address to where the product may be sent to. You may choose not to provide an address, but in this case, Wacom will not be able to provide you the product. Your address will be deleted after you received the product.

2.5   The winning portfolio will be part of a post-event blog article. Wacom will align with the winner which personal data may be revealed in the article (e.g. your name, Job title, experience). Your preferences and your consent will be documented in the consent form that needs to be signed in order to join the Live session.

2.6    All portfolios with the name of the artists will be stored in a password protected file, accessible on a strict need to know basis and will be deleted 30 days after the Event ended.

 

Event Privacy Notice

  1. Your Personal Information

1.1 When you apply for the Event (as defined in the Event Terms (https://www.wacom.com/events/terms-of-use), you must register your name, contact information (telephone, email address, etc.) and other necessary items through the website of one of Wacom Co., Ltd. and its affiliates (collectively, “Wacom”).

1.2 You may also wish to provide to Wacom any User Contents as set forth in the  Event Terms, which includes personal information such as your artworks, portfolio, photographs, drawings, letters, comments, ideas, job title and past job experiences and feedbacks, during your participation in the Event.   

1.3 You agree that Wacom may use your personal information obtained through registration for the Event for the purposes set forth in Wacom’s privacy policy (https://www.wacom.com/privacy) (“Privacy Policy”) which you will agree with separately and the following purposes. If Wacom uses your personal information for any other purposes, you will be notified of those purposes.

  1. Operation of the Event online and offline including offering tickets handled by Wacom (for example, acceptance of an application, delivery or exchange on the day of tickets);
  2. Services incidental to (a) above (for example, sending communications regarding the Event such as registration confirmation and Event reminder emails, announcements by e-mail, postal mail, telephone, etc. of schedule and content changes and cancellations and further guidance of the Event, as well as confirmatory notifications that are deemed necessary in the course of business and follow up emails after the Event);
  3. Sending emails with the link to the sessions of the Event and (only if you have opted-in) sending Wacom e-Store offers and Event partners marketing emails;
  4. User support for the Event (for example, responding to inquiries);
  5. Making statistical materials compiled in a manner that does not identify or specify individuals, and conducting market analysis by using them, for the reference for sales activities and development of new services;
  6. Use and record of access information (for example, Internet, mobile sites, phones, etc.) for system operation and management and for responding to inquiries; and
  7. Other matters accompanying (a) to (f) above.

1.4 Wacom shall not disclose to a third party any information obtained by Wacom in the course of your registration for and participation in the Event without a justifiable reason, except in the following cases:

  1. in case Wacom holds the Event on such platforms as Zoom meeting, webinar and on YouTube, streams the contents of the Event and records, shoots and visual records them on such platforms as Zoom and YouTube, posts and distributes them on Wacom’ s website, YouTube channel and other SNS, and uses and publicizes them in various media for advertisement and promotion activities as set forth in 5.2 of the Event Terms;
  2. in case at the Event Venue (defined in the Event Terms) Wacom or those designated by Wacom audio record, shoot and visual record the Event in which you, your personal information or your User Contents may appear, stream it using such platforms as Zoom and YouTube, post and distribute it on Wacom’s website, YouTube channel and other SNS and use and publish it on various media for advertisement and promotion activities as set forth in 6.2 of the Event Terms;
  3. in case Wacom may cooperate with relevant authorities in relation to COVID-19 measures or for other security purposes, as from time to time set forth in the Event Specific Notes in the Event Terms;
  4. in case providing your registration information, etc., to participating companies such as Event sponsors for promotional purposes, the event of which you have participated in or accessed;
  5. in case sharing your provided information to speakers, coordinators or staff of the Event in which you participate, whether they are Wacom employees or not.
  6. in case you consent to the disclosure of your personal information (your name, address, telephone number, e-mail address, etc.);
  7. in case Wacom discloses the statistical information collected for the purpose of grasping the participation trend of this Event in a manner that does not identify individuals;
  8. in case of providing managers of the Event Venue(s) with all or part of the personal information of the ticket purchasers (your name, address, telephone number, etc.) for identification purpose when your entering the Event Venue;
  9. in case of infringement or threat of infringement of copyrights, property rights, privacy, honor, trust or other rights of other participants, third parties or Wacom;
  10. in addition to the preceding item, in case any disadvantage or damage is caused or threatened to be caused to other participants, third parties, or Wacom;
  11. in case disclosure is permitted by laws and regulations;
  12. in case disclosure is required by laws;
  13. in case of request from public authorities; and
  14. in other cases where it is necessary for the operation of this Event.

1.5 You may be asked by Wacom to separately give a consent to data processing of personal information in a form prescribed by Wacom if you wish to provide your User Contents or any additional personal information during your participation in the Event.

1.6 It is your obligation to ensure that there is no personal data of third parties included in the User Contents provided by you.  Otherwise, it is your responsibility (and you shall also be liable for it) to ensure that you received a proper consent of the person whose data is disclosed in the User Contents in advance. This consent must fulfil the requirements of all applicable data protection laws and regulations. Wacom will, under no circumstances accept such a responsibility or liability. If requested by Wacom, you will provide the consent of the third person to Wacom.

  1. Involved Personnel of Sponsors Participating in This Event

If you are involved personnel of sponsors participating in this Event (“Involved Personnel”), Wacom may use your personal information for the purpose below in addition to those set forth in 1.3 above.

Wacom may use Involved Personnel’s personal information obtained through registration for the Event for the purpose to identify persons who are authorized to control exhibitions of sponsors on an online platform provided by Wacom to sponsors.

  1. Deregistration and Post-Event Deletion of Personal Data

3.1  You can deregister from the Event any time in accordance with the Event Terms, and in such case, your personal data collected at the time of registration will be forthwith removed and the processing of such data will cease except for the following, provided, however that any personal information you have posted in the Event before the deregistration request may not be removed:
a. personal information for sending marketing emails if you have opted in the receipt of marketing emails; and
b. personal information for Wacom ID when you are Wacom ID holder.

Forthwith after the deregistration, Wacom will try to, but is not obliged to, delete the User Contents provided by you for the Event to the extent possible:

In addition, you may request to delete your personal data in accordance with Wacom’s Privacy Policy.  Further information on the rights as an affected party can be found in Wacom’s Privacy Policy.  

3.2 Your personal data provided by you during the registration process will be deleted shortly after the post-event emails are sent to you by Wacom except for the following:
a. personal information for sending marketing emails if you have opted in the receipt of marketing emails; and
b. personal information for Wacom ID when you are Wacom ID holder.

However, User Contents provided by you during participation in the Event (if any) will be stored for an indefinite period or until you or other relevant persons of the Contents request the deletion.

  1. Joining the Event on Zoom and YouTube.

4.1       The Event may be held, streamed, recorded and posted and distributed on Zoom, YouTube and any other platform which Wacom notifies in the Event Specific Privacy Notice from time to time ("Zoom and YouTube, etc.”).  Those who watch the Event on Zoom and YouTube, etc. should be aware that the terms and conditions, the privacy policy and any other policies of Zoom and YouTube, etc. will be applicable.

4.2       The account name with which you sign in on Zoom and YouTube, etc. will be seen by Wacom as a host of the Event or its service providers for the Event and will be shown in the chat and comments of Zoom and YouTube, etc. in case you decide to use these functions.

4.3       Wacom will not use any personal data (if any) appearing on YouTube/Zoom´s chat and comment functions in relation to the recorded session uploaded by Wacom on Zoom and YouTube, etc.

4.4       Any personal data you might post in  chat and comment functions of Zoom and YouTube, etc. can be globally seen or accessed. Please acknowledge this and be aware that you post any personal data at your own responsibility.

  1. Changes and Updates to this Event Privacy Notice, Etc.

Wacom reserves the right to modify this Event Privacy Notice at any time. If Wacom makes a material change to this Event Privacy Notice, Wacom will notify you in the same manner as described in the Event Terms.  It is your responsibility to keep current your contact information that Wacom has on file.

 

Wacom may further provide event specific privacy notice only applicable to a particular Event (“Event Specific Privacy Notice”), which constitute a part of the Event Privacy Notice in relation to the applicable Event.

  1. Data Transfer

By agreeing to receive Wacom email communications during the registration, you consent that the data you provide in the course of your registration will be shared with affiliated companies of the Wacom Group and with the event sponsor for promotional purposes. The list of sponsors can be seen at the Event Specific Privacy Note for each Event. These companies will use the data for their promotional purposes and contact you with information about their services.

 

By agreeing to this Privacy Notice, you consent to your personal data being shared with affiliates in the Wacom Group and the event sponsor for the purpose of providing our services in connection with the Event. Because of the global nature of our business, a co-operation among the affiliates in the Wacom Group with respect to certain parts of the Services is established.

 

You are aware that, when information is shared within the Wacom Group or the sponsors, your personal data might be processed outside of your local jurisdiction, including without limitation the European Economic Area (EEA), Japan and/or in third countries like the United States. You are aware that the level of data protection in unsecure third countries like the United States is much lower than the level of data protection in the EU, according to the General Data Protection Regulation. In such countries, authorities and public bodies in particular (e.g. as part of comprehensive monitoring programs) may have access to your data processed by Wacom and inspect it.

 

You hereby expressly consent to the processing of your data outside of the EU/EEA.

You can withdraw your consent at any time effective for the future. To do so, send us an e-mail to the contact details provided in the Privacy Policy.  The withdrawal does not affect the lawfulness of the data processing up to the time of the withdrawal.
